This Acceptable Use Policy (the “Policy”) forms part of the OHM Platform Terms of Service and applies to all access to and use of the OHM Platform and the Services.
This Policy specifies the rules applicable to the use of the OHM Platform and the Services, including restrictions relating to content, business models, jurisdictions, conduct, and use of Advertising Platforms and third-party services.
Capitalised terms used but not defined in this Policy shall have the meanings given to them in the applicable OHM Platform Terms of Service.
- General principle
- The Client may use the OHM Platform and the Services only in a lawful manner, in accordance with the OHM Terms of Service, this Policy, other OHM Policies, Applicable Law, and all applicable Third-Party Platform Rules.
- Prohibited use
- The Client shall not use the OHM Platform or the Services for any Prohibited Activity as defined by OHM Platform Terms of Service and this Policy.
In particular, the Client shall not:
- provide false, incomplete, misleading, or outdated information to OHM;
- use the Services in connection with unlawful, deceptive, fraudulent, abusive, or manipulative conduct;
- interfere with, misuse, damage, test, disrupt, or attempt to gain unauthorised access to the OHM Platform, any system related thereto, or any Advertising Platform;
- circumvent or attempt to circumvent any restriction, limitation, review, reserve, compliance requirement, or risk control imposed by OHM, Advertising Platform, or by any other third party used in connection with the Services;
- use the Services in a manner that may create harm, liability, or reputational damage for OHM, the OHM Platform, any Advertising Platform, or any third party;
- advertise or otherwise promote through Advertising Platforms:
- any counterfeit goods;
- dangerous products or services;
- weapons;
- political content;
- trafficking;
- violence;
- drugs;
- adware;
- malware;
- viruses;
- any other content, goods, or services prohibited under applicable Third-Party Platform Rules.
- use cloaking, misrepresentation, impersonation, hidden redirects, misleading claims, hidden ownership structures, fake identities, or any similar technique intended to mislead OHM, any Advertising Platform, Processing Partner, Verification Provider, or any third party when using the Services or Advertising Platforms;
- use the Services to support, facilitate, or conceal spam, phishing, scam activity, malware distribution, unauthorised tracking, or abusive/deceptive traffic practices (incl. “dark patterns”), including distribution of any materials anyhow related to such activities within the Advertising Platforms;
- use the Services in any way intended to avoid, weaken, or exploit OHM’s onboarding, verification, compliance, billing, or payment controls.
The above list is not exhaustive and shall not be interpreted as providing for any limitation for the definition of the term “Prohibited Activity” as per the OHM Platform Terms of Service.
- Restricted businesses and restricted jurisdictions
- The Client shall not use the OHM Platform or the Services in connection with any Restricted Business or Restricted Jurisdiction as provided in Schedules A and B to this Policy.
- OHM may determine, update, expand, reduce, or otherwise modify the scope of Restricted Businesses and Restricted Jurisdictions at any time by updating the Schedules A and B to this Policy. Any such determination shall apply as of the date of publishing of a new amended versions of Schedules A and B.
- Please note that OHM reserves the right to restrict any business, activity or jurisdiction that is not listed in the Schedules A and B hereto at any time and without explanation of the reasons.
- Compliance with Advertising Platform rules
- The Client is solely responsible for ensuring that its campaigns, and any creatives, materials online sources, landing pages, domains, targeting settings, payment methods, and related activities comply with all applicable Third-Party Platform Rules.
- OHM does not approve, control, or assume responsibility for the Client’s campaigns or business activities merely because the Client uses the OHM Platform or the Services. Nothing in this Policy, the OHM Terms of Service, any onboarding approval, Commercial Terms, payment acceptance, or continued access to the OHM Platform shall be interpreted as approval by OHM of any specific campaign, activity, product, service, jurisdiction, or business model.
- The Client acknowledges that any breach of Third-Party Platform Rules may result in adverse consequences not only for the Client, but also for OHM, the OHM Platform, and other OHM clients or integrations. The Client shall therefore ensure that no use of the Services causes, or is likely to cause, any limitation, restriction, review, suspension, takedown, or blocking of any Advertising Platform account, integration, or related functionality used by or through OHM.
- Shall any adverse consequence envisaged by this section occur for OHM due to the Client’s conduct the Client shall be liable for any damages and losses caused. Additionally, in that case OHM shall be entitled to withhold any advance payment of the Client as a contractual penalty.
- Monitoring and enforcement
- OHM may monitor compliance with this Policy to the extent reasonably necessary for the operation, protection, and enforcement of the OHM Platform and the Services and for compliance with any Third-Party Platform Policy.
- If OHM considers that the Client has breached, or may breach, this Policy, OHM may, at any time and without prior notice:
- refuse onboarding;
- request additional information or documents;
- restrict or condition access to the OHM Platform or the Services;
- suspend, block, or terminate the Client’s account/access to the OHM Platform or the Services (including their access to any Advertising Platform);
- block or remove specific functionality, campaigns, or activities;
- take any other measure permitted under this Policy, the OHM Terms of Service or Applicable Law.
- The Client shall cooperate in good faith with any review, investigation, complaint, compliance matter, or risk assessment initiated by any Advertising Platform, Verification Provider or Processing Partner relating to the Client’s use of the relevant Advertising Platform, OHM Platform or the Services. The Client shall promptly provide any information, documents, explanations, licences, or other materials reasonably requested by OHM in connection with the application of this Policy.
- Failure to cooperate, or provision of inaccurate or misleading information, shall itself constitute a breach of this Policy.
- Changes to this Policy
- OHM may amend or update this Policy from time to time. Any amendment may be published through the OHM Platform, communicated by email, through account communications, or by any other reasonable means. Continued use of the OHM Platform or the Services after the effective date of an updated Policy shall constitute acceptance of the updated Policy.
SCHEDULE A
to the OHM Applicable Use Policy
- Restricted / approval-only categories
- The businesses related to the following activities/categories are completely prohibited to use OHM Platform:
- Distributing of counterfeit goods;
- Distributing of dangerous products or services;
- Production and/or distributing of weapons;
- Any political activities;
- Trafficking;
- Violence;
- Drugs;
- Production and/or distribution of adware, malware, viruses, or similar harmful software or code.
- The businesses related to the following activities/categories are subject to restrictions and enhanced controls by OHM:
- Any iGaming products or services;
- Financial services (including, but not limited to any trading, investment services whatsoever);
- Social & Entertainment;
- Healthcare, medicine, supplements, and health-related products or services;
- Alcohol, tobacco, nicotine, smoking-related products, and related accessories;
- VPNs and any similar tools/utilities.
- OHM may impose any conditions it considers appropriate in relation to a business mentioned in p. 1.2 of this Schedule, including:
- enhanced onboarding, verification, or reverification;
- provision of licences, permits, approvals, or legal opinions;
- restrictions on jurisdictions, targeting, or campaign types;
- restrictions on payment methods or Campaign Funding arrangements;
- additional monitoring, limits, or reporting requirements;
- any other compliance, operational, or risk-control condition.
- No onboarding approval, payment acceptance, continued access to the OHM Platform, or continued provision of the Services shall be interpreted as approval of any restricted business unless OHM has expressly confirmed such approval in writing.
SCHEDULE B
to the OHM Applicable Use Policy
- Prohibited jurisdictions
- The Client shall not use the OHM Platform or the Services in connection with any of the following jurisdictions:
- Belarus
- Cuba
- Crimea, Donetsk and Luhansk regions of Ukraine
- Iran
- North Korea
- Russia
- Sudan
- Syria
- Venezuela
- The prohibition in this Schedule applies to any use of the OHM Platform or the Services that is connected with a listed jurisdiction, including where such connection relates to the Client’s place of incorporation, establishment, residence, or operations, beneficial ownership or control, target markets or advertising activity, products or services, customers or counterparties, funds or payment flows, or other relevant circumstances.
- Where the Client is connected, directly or indirectly, with a jurisdiction listed in this Schedule, or where OHM reasonably believes that such connection exists, OHM may refuse onboarding, restrict access to the OHM Platform, suspend the Services, impose additional requirements, or terminate the agreement with the Client.
